RETAINER AGREEMENT
Fiancée Visa (K-1)
Basic Package

    THIS FEE AGREEMENT made and entered into this _____ day of _______________, 2007, between _____________________, hereinafter referred to as "Client", and A Foreign Affair, hereinafter referred to as "AFA" with offices at 7320 N. Dreamy Draw Drive, Ste. 240, Phoenix, Arizona 85020. Legal services will be performed by the Law Offices of Laurie Wu, hereinafter referred to as "Attorney" located at 16 Rebecca Court Old Bridge NJ 08857, as an in-house counsel for AFA. It is understood that Attorney cannot represent Client in private matters and Client is advised to seek a legal assistance of an independent counsel.

  1. Beginning of Representation Representation in K-1 process will start upon signature of the Agreement by Client. Attorney will initiate the process by taking necessary steps in order to assemble K-1 package.
  2. End of Representation Representation will end upon the approval of the I-129F Petition by USCIS. AFA and Attorney are not responsible for any further process and outcome of the case after an approval of I-129F petition by the USCIS.
  3. Preparation and assembly of the I-129F Petition Once we receive all the documents and information from you, we will prepare the I-129F Petition. We will not submit an I-129F Petition until we are absolutely confident that it is complete and there are no problems that may cause a delay. Once we are confident that the petition is ready for submission we will Express Mail it to you for your final signature. You will sign it as indicated by our instructions and send it back to our Attorney so that Attorney may check it one last time and file it with the appropriate Service Center.
  4. Contact with your Fiancée. Before submitting the I-129F Petition, we will make sure that your Fiancée is aware of every step of the process. Our office will communicate with your Fiancée throughout the whole process by phone, fax or e-mail.
    · Fiancée is entitled to three personal conversations (phone/e-mail) with Attorney - at the beginning of the process (before Petition is filed);
    · Petitioner is entitled to an unlimited access to Attorney's assistants and AFA.
    · Fiancée is entitles to an unlimited access to Attorney's assistants and AFA.
  5. Follow up once the Petition has been submitted. We will continue to monitor your petition until approval while your case is in the United States Service Center. We will keep you apprised of the progress as the petition advances through our web site and e-mails. If the petition is not approved in a reasonable amount of time for the specific service center we will make inquires on your behalf as to the status of the petition. Additional fees might be applicable.
  6. Translations. Translation services of all necessary documents for the K-1 package are not included in the price of the package.
  7. The Client's Responsibility. Client must fully cooperate with our office and provide all relevant information and necessary documents for the Fiancée visas process. Attorney may withdraw from your representation if you do not cooperate with our office and/or are planning to commit fraud or other crimes. In this case, the Fee shall not be refundable.
  8. Costs & Expenses. Cost for Basic Package is $1200 not including filing fees. It is an absolute responsibility of Client to have all the funds available for AFA upon signing of the Agreement. Client has a right to upgrade Basic package to a Premium package by paying an additional $300. Client will be responsible for additional fees, such as: mailing fees, copying fees, communication fees and any others expenses in connection with K-1 process. Copies are available only upon Client's request.
  9. Deposit Client has a right to pay a deposit of a minimum of $500. It is understood that AFA and its Attorney will not start any work on the K-1 process until a complete amount is paid by Client. It is an absolute responsibility of Client to have all the funds available for AFA upon signing of the Agreement.
  10. Confidentiality. All information received from you, your Fiancée or your representative on your behalf in writing or orally is confidential and shall be used only by our office for the purpose of the completion of the Fiancée visa process.
  11. Refunds. Client is entitled to a refund in the event if Client cancels the process with or without any reason:

    · 85% refund - Clients received package and cancels service;
    · 65% refund - Client received package, all forms have been completed and Client cancels service;
    · 50% refund - Client received package, all forms and supporting documents are assembled by Attorney;
    · No refund - if K-1 package has been filed with the USCIS.

    Client understands that the mailing and translation fees are non-refundable.
  12. Signature. Client acknowledges by his/her signature that he/she has read and agreed to the provisions of this Agreement. Client also acknowledges that he/she has had the opportunity to have any questions answered and this Agreement fully explained to Client's satisfaction. Client also acknowledges that he/she has been given a copy of this Agreement.
